Rules

• To submit a photo online, click on the Participate tab (above) and follow the directions to upload a photograph of your pet. Photos should be submitted in JPEG format. Multiple photos can be submitted, but only one photo can be submitted at a time.
• There is NO entry fee/donation for submitting a photo in the Summer Fun with your Pet! 2021 Photo Contest.
• The entry and voting period will run from Thursday, July 1st to Sunday, August 1st at 9:00 PM PST (we recommend entering as early as possible for best chance at winning!)
• Your pet does not have to be adopted from East Bay SPCA to be eligible to enter this contest, and photos of all pets are accepted (does not need to be just a cat or dog!).
• All photos must be submitted by the photographer who took the photo. The East Bay SPCA cannot accept copyrighted photos unless the owner of the copyright agrees to the usage rights of the East Bay SPCA Contest.
• If photos include pets not owned by the photographer, or people not in the photographer's immediate family, written permission from the pet's owner and/or the individuals photographed allowing for the East Bay SPCA to use their images according to the rules of this contest is required.
• By submitting your photo(s), you are authorizing the East Bay SPCA to use this media for East Bay SPCA printed and/or online publications and communications such as newsletters, brochures, videos, website, social media, direct mail appeals, fundraising materials, etc. As such, you are agreeing to hold East Bay SPCA free, harmless and indemnify it from all liability, personal and property damages including attorney fees and costs arising from the use or publication of your photo(s). You will not receive any financial compensation for future use.
• The safety of pets is the number one priority. Please be mindful of your pet’s wellbeing and comfort when wearing costumes and only place pets in the costume for the photo. Avoid putting on costumes or accessories that may cause distress. The East Bay SPCA reserves the right to remove the photo if deemed in appropriate.
• Costumes should not restrict the animal’s movement or hearing, or impede their ability to see, breathe, or make vocalizations.
• Employees of the East Bay SPCA are welcome to enter and fundraise, but are not eligible for prizes. 

Once a photo is submitted, it will appear in the online gallery and be open to voting by the general public. $1 donation = 1 vote. Receive 25 additional votes for each $25 vote donation. The promotion only applies to donations in a single transaction and does not apply to any donations for votes during the entry process. (Please note that there is a minimum donation of $5). All votes for photo submissions will be tabulated and displayed online. Votes can be cast for any submitted photo in one-vote increments. Voters are given the option of applying all of their votes to one photo, spreading their votes over various photos, or storing votes in their account for later use. All votes must be applied to selected photos by the conclusion of the voting period to be counted.

The online voting period will end August 1st, 2021, 9:00 PM PST. A clock will be displayed on the contest web page during the final day of the contest. Winners will be determined based on the number of votes appearing on the website at the close of voting. Note: there may be a gap of 15 minutes from when a vote is cast to when it appears online. Voters are urged to cast their votes at least 15 minutes before the contest ends. The East Bay SPCA is not liable for votes not appearing on the website and cannot refund donations for votes that do not appear after the deadline has passed. All votes and entry are donations to the East Bay SPCA and are fully tax-deductible as permitted by law.

Note for Prize Winners: All taxes on prizes, including but not limited to federal, state and local taxes, are the responsibility of the winners. Please consult your tax adviser for additional information. The East Bay SPCA may, at its sole discretion, choose to substitute a prize of equal or greater value in the event the offered prize is unavailable. Prizes are not redeemable for cash or exchangeable.
